Processing of personal data

Since 25 May 2018, Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “Regulation”) applies across all European Union member states, together with Romanian Law no. 190/2018 on measures implementing Regulation (EU) 2016/679. The Regulation aims to create a single, uniform legislative framework across the European Union that no longer requires separate national implementing measures.

J07/323/2005 (EUID: ROONRC.J07/323/2005), tax ID (CUI) 17550041, referred to below as “CloudEBS” or “the controller”, is the data controller for the website www.cloudebs.com, through its legal representative Cosuleanu Gelu.

In order to meet our obligations under the Regulation, and because protecting your data is a major, ongoing priority for us, we have put together this document. It sets out the categories of personal data we collect when you visit our website, the purpose and legal basis for processing it, how long we keep it, where we store it and who we share it with, as well as the rights you have as a data subject — all designed to protect your fundamental rights and freedoms, and in particular your right to the protection of personal data.

1. Definitions

• “personal data” any information relating to an identified or identifiable natural person (the “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

• “processing” means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

• “controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law;

• “processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;

• “recipient” means a natural or legal person, public authority, agency or other body to which the personal data are disclosed, whether or not a third party.

We process your personal data lawfully, fairly and transparently, only for the explicit purposes we have made known to you.
NETWORKING CONSULTING SRL, as controller, processes data in a manner that ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, through appropriate technical and organisational measures.

2. The personal data we process. Purpose. Legal basis. Retention period

We only collect the personal data we actually need in order to contact you back, answer your questions and requests, and — where the law allows this or you’ve given us your consent — keep you up to date on our products, services and offers (direct marketing).

In general, we process the following categories of your personal data:

• Name – only if you send us a message through the contact form or apply for a job.

• Email address – if you send us a message through the contact form, apply for a job, or subscribe to our newsletter.

• Phone number – only if you send us a message through the contact form.

Each category of data is collected for specified, explicit and legitimate purposes and is not further processed in a way incompatible with those purposes; it is kept for no longer than necessary to fulfil the purposes for which it is processed.

To keep things transparent, here’s exactly how we process your data, for what purposes, and on what legal basis.

FILLING IN THE CONTACT FORM

• To help us find the best solution for your online store, you can fill in the contact form on www.cloudebs.com. When you do, we ask for and collect your name, email address and phone number.

• We need this data to answer your questions or requests, and to get back to you about the services we offer.

• We keep your personal data only for as long as strictly necessary to fulfil the purposes for which it was collected and processed. Exceptions apply where processing is carried out solely for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes.

• Your personal data may be disclosed to our sales, marketing and other departments within NETWORKING CONSULTING SRL that are involved in processing personal data.

JOB APPLICATIONS (CAREERS)

If you apply for a role through the form on our Careers page, we collect your name, email address, the role you’re applying for, and the content of your message. We use this data solely to evaluate your application for that specific role, and delete it once the recruitment process is completed.

NEWSLETTER – DIRECT MARKETING

Subscribing to and unsubscribing from the www.cloudebs.com newsletter is free, voluntary, and based solely on your consent. The newsletter is a periodic, email-only way for us to share news about our services and promotions, without any commitment on the part of NETWORKING CONSULTING SRL regarding the information it contains.

To provide this service, we collect your email address. We use it exclusively to keep you up to date on our products, services and offers. The legal basis for this processing is the consent you give when confirming your subscription; we keep processing your data for as long as that consent stands.

You can withdraw your consent at any time by emailing contact@cloudebs.com or by clicking the unsubscribe link in any newsletter email you receive from us; this will stop the processing going forward. Withdrawing consent doesn’t affect the lawfulness of processing carried out before the withdrawal.

Your personal data processed for direct marketing purposes is stored in our newsletter platform, Mailchimp (operated by The Rocket Science Group LLC, part of Intuit Inc., USA). This transfer to the US is carried out under the safeguards required by the Regulation — Mailchimp is actively certified under the EU-U.S. Data Privacy Framework, a mechanism that ensures a level of protection equivalent to that within the European Union.

COOKIES

www.cloudebs.com uses a cookie consent management system that lets you accept, refuse or customise cookies before they are placed on your device, except for cookies that are strictly necessary for the site to function. You can manage these preferences at any time from the “Manage consent” link in the site footer.

We use cookies organised into the following categories: Functional, Preferences, Statistics and Anonymous statistics, and Marketing/Advertising. The site may also load third-party services that set their own cookies or process data when you interact with them: Google Fonts, Google reCAPTCHA and YouTube. These services are only loaded once you’ve given consent for the relevant category, except for the strictly necessary ones. Full details are available in our Cookie Policy and in the consent banner shown on your first visit.

You can access our website without cookies too. If you’d rather we didn’t recognise your computer, you can block cookies from being stored on your device by disabling cookies in your browser settings. Check your browser’s instructions for details. If you don’t accept cookies, some of our offerings may not work as intended.

NETWORKING CONSULTING SRL has no access to and cannot control cookies set by other websites. You’re responsible for reading the applicable policies on those sites.

3. Security of your personal data

The security of your personal data is a priority for us. Any processing we carry out follows the principles guaranteed by the Regulation and ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, through appropriate technical and organisational measures and suitable internal data-protection policies.

This site adopts all the security measures needed to protect our users’ personal information. When you submit personal data on our site, that information is protected both offline and online. All personal data is processed through secure pages using SSL encryption.

4. Your rights as a data subject

Regulation 2016/679 protects the fundamental rights and freedoms of natural persons, and in particular their right to the protection of personal data. Regarding your personal data, you have the right to exercise any of the following:

• Right of access: you can ask us to confirm which categories of your personal data are being processed, the purpose of that processing, the recipients data has been or will be shared with, how long it will be stored (or the criteria used to decide this), and whether any automated decision-making, including profiling, is involved.

• Right to rectification: if any of your data is inaccurate, you can ask us to correct or complete it. We will notify any recipient the data was shared with of the correction, unless this proves impossible or requires disproportionate effort.

• Right to restriction of processing: you can ask us to restrict processing in specific situations — for example, while we verify contested data accuracy, where processing is unlawful and you oppose erasure, where we no longer need the data but you need it to establish, exercise or defend a legal claim, or while we assess whether our legitimate grounds override your objection.

• Right to erasure: you can ask us to delete your data where it’s no longer needed for the purposes it was collected for, where you withdraw consent and no other legal basis applies, where you object to processing and there are no overriding legitimate grounds, where the data was processed unlawfully, where erasure is required to comply with a legal obligation, or where the data was collected in relation to information society services.

• Right to data portability: you can request that your data be transferred to another controller, where processing is based on your consent and carried out by automated means.

• Right to object: you can object at any time to processing of your data for direct marketing purposes, including profiling — in which case we will delete your data.

• Right not to be subject to a decision based solely on automated processing, including profiling.

5. Contact details

This Policy is complemented by NETWORKING CONSULTING SRL’s other specific policies and by the Terms and Conditions available on our website. Any change to the terms of this Policy will be published on our website, so that users remain informed about the information we collect, how we use it and, where relevant, the circumstances under which we disclose it. Users may or may not consent to their information being used for other purposes; we will use information in line with the policy under which it was collected.

This notice applies only to our own website and does not extend to third-party websites that may be accessed through it. We have no control over how those third parties process data and accept no responsibility or liability in connection with their websites.
